Background to incident

On Tuesday 11 April 2006, just after noon, an independent tied perimeter scaffold collapsed at McAleer & Rushe construction site in Milton Keynes. The collapse started on the West Elevation (facing Witan Gate), with a partial collapse of the North Elevation (facing Midsummer Boulevard). The scaffold collapse was contained within the Jury's Inn site boundary.  Three workers who were on the scaffold sustained multiple injuries. Sadly, one worker, John Robinson, died 3 days later in hospital.

Following its investigation into the fatal scaffold collapse at Milton Keynes in April 2006, HSE has announced its decision to bring criminal proceedings against: McAleer & Rushe Limited of Cookstown, Northern Ireland, Lee Smith Carpentry Limited of Romsey Hampshire, NNM Scaffolding Limited of Leicester and Mr John King, Director of NNM Scaffolding Ltd. All parties have been summonsed to appear before Milton Keynes Magistrates' Court on Friday 13 February 2009.

Terrible for the family of the victim having to wait nearly three years before it even goes to court

I know a bit about this case; the reason it took so long was that HSE had a huge amount of evidence to go through to determine exactly who was at fault rather than just hitting the site managers and main contractor.

I believe the job was made somewhat harder by the mixture of different trades that had been working in the vicinity and the responsibility for the scaffolding falling between two different companies, none of which wanted to take responsibility for the accident.

Thats fair enough, if the time was to do the job properly (as it seems) rather than just fighting through red tape (as things like this seem to be)

Trouble is they will only get fined a few grand for killing someone, but hey if you kill somebody in car the average fine is only £400
